Terms of Service

1. The service

Castan provides a workspace that connects to sources you authorize (email, chat, meetings, code, financial records), organizes that data for your company, answers questions about it, and runs agents you approve. Castan is operated by the company identified at the foot of this page ("we", "us").

2. Accounts and workspaces

You need an account to use Castan. A workspace belongs to the company that created it; workspace owners control membership through invites and are responsible for who they admit. You are responsible for activity under your account and for keeping credentials confidential.

3. Your data

Data you connect or upload stays yours. You grant us the rights needed to operate the service: storing, indexing, processing with machine-learning models, and displaying it back to your workspace. We never sell your data and never use it to train models for other customers. Connections are read-only unless a feature explicitly states otherwise and you approve it. 4. Meeting capture

When you send the Castan assistant to a meeting, it joins visibly under the Castan name and captures the conversation for your workspace. You are responsible for satisfying any notice or consent requirements that apply to recording in your jurisdiction and for informing participants.

5. Agents and AI output

Castan is an AI that builds and runs a small company with its owner and asks before it acts. Its drafts, summaries, assessments and code changes are generated with AI, and output can be wrong. Agent actions that leave your workspace (emails, pull requests, deployments) require your configuration and, by default, your approval. You review before you rely; Castan is not legal, tax, accounting or investment advice.

6. Payments, cancellation and withdrawal

Paid plans bill per workspace, monthly, through Stripe, at the price shown at the time of the order; Studio run packs are one-time purchases. The company issuing your invoices is not registered for VAT, so prices are final and no VAT is added. Usage beyond plan allowances is capped, not billed by surprise. There is no minimum term: you can cancel any time from Settings → Billing and the plan runs to the end of the paid period; nothing is charged after that. The order is placed when you press the payment button on the payment page and confirmed by the email we send right after; that email is your record of the contract.

Business customers. If you buy as a company or in the course of a trade, business, craft or profession, you are not a consumer: the right of withdrawal below does not apply, and fees for a period already started are not refunded except where the law says otherwise.

Consumers: right of withdrawal. If you buy as an individual, you may withdraw from the contract within 14 days from the day you receive the order confirmation email, without giving any reason. To withdraw, use the function "Withdraw from the contract here" in Settings → Billing, which stays available for the whole 14 days and sends you a confirmation of receipt with the content, date and time of your declaration; or send an unequivocal statement to hello@castan.ai or by post to Intr. Gheorghe Simionescu 19 Ap. B26, for example using the model form below. You meet the deadline if you send the statement before the 14 days expire.

Starting the service at once. On the payment page we ask you to tick a box requesting that the service starts right away, during the withdrawal period, and confirming that you understand that the right of withdrawal is lost once the service has been fully performed. If you then withdraw within the 14 days, you owe an amount proportional to the service provided until the day you informed us (the monthly price divided by the days in the billing period, times the days used) and we refund the rest within 14 days of your withdrawal, to the payment method you used, at no cost to you. If you did not tick the box, you owe nothing for the days used and the full amount is refunded. After withdrawal the plan ends and the workspace continues on the free tier; you may export your data from Settings.

B26, hello@castan.ai: I hereby give notice that I withdraw from my contract for the provision of the following service: [plan or purchase]. Ordered on [date]. Name of consumer. Address of consumer. Signature (only if sent on paper). Date.

Complaints, conformity, updates. Complaints go to hello@castan.ai; we acknowledge them within two business days and answer within 14 days. Consumers benefit from the legal guarantee of conformity for digital services under Romanian and EU law. We supply updates, including security updates, for as long as your subscription runs, and we announce material changes that affect your use in advance. If we cannot settle a complaint, consumers may use the alternative dispute resolution procedure of ANPC (SAL); details are at the foot of this page.

6a. Informații pentru consumatori (română)

Serviciul Castan este furnizat de OCULI OMNIUM SRL, CUI 52198491, J2025054313009, cu sediul în Intr. Gheorghe Simionescu 19 Ap. B26, e-mail hello@castan.ai. Societatea nu este înregistrată în scopuri de TVA (art. 310 Cod fiscal); prețurile afișate sunt finale și nu includ TVA. Abonamentele se facturează lunar, fără durată minimă; puteți renunța oricând din Setări → Facturare, serviciul continuând până la sfârșitul perioadei plătite.

Dreptul de retragere. Dacă achiziționați ca persoană fizică, aveți dreptul de a vă retrage din contract în termen de 14 zile de la primirea e-mailului de confirmare a comenzii, fără a fi nevoie să justificați decizia. Vă puteți retrage folosind funcția „Retrageți-vă din contract aici” din Setări → Facturare (disponibilă pe toată durata celor 14 zile; veți primi confirmarea de primire cu conținutul, data și ora declarației) sau printr-o declarație neechivocă trimisă la hello@castan.ai. Întrucât ați solicitat expres începerea prestării în perioada de retragere și ați confirmat că pierdeți dreptul de retragere după executarea integrală, în caz de retragere datorați o sumă proporțională cu serviciul furnizat până la momentul informării noastre (art. 14 alin. (5) OUG 34/2014); diferența vă este rambursată în cel mult 14 zile, cu același mijloc de plată. Dacă nu ați bifat solicitarea, nu datorați nimic și rambursăm întreaga sumă.

Reclamații și litigii. Reclamațiile se trimit la hello@castan.ai; confirmăm primirea în două zile lucrătoare și răspundem în cel mult 14 zile. Consumatorii beneficiază de garanția legală de conformitate pentru serviciile digitale (OUG 141/2021). Dacă o reclamație nu poate fi soluționată direct, vă puteți adresa Autorității Naționale pentru Protecția Consumatorilor (ANPC, Bd. Aviatorilor 72, București, telefon 021 9551, anpc.ro) și entității SAL a ANPC prin platforma reclamatiisal.anpc.ro.

7. Acceptable use and published pages

No unlawful use, no connecting data you lack the right to connect, no probing or disrupting the service, no reselling without an agreement, and no use to build a competing dataset. We may apply fair-use limits to keep the service healthy for everyone.

Pages you publish through Castan. A page Castan hosts for you is published by you, under your name, and you are responsible for it. It may inform and invite people to a waitlist and nothing else: no checkout, no sign-in, no collection of data beyond the waitlist form, no impersonation of any person or organisation, no unlawful, misleading, defamatory or infringing content, no medical, legal or financial claims you cannot stand behind. Every page carries a report link; when we receive a notice we look at it promptly and take the page down if the notice is founded, and we may take a page down without notice where the law or the safety of others requires it. Notices go to hello@castan.ai; we act as a hosting provider in the sense of the e-commerce rules and do not review pages before publication.

8. Termination

You can delete your workspace at any time (see the Privacy Policy for the deletion process). We may suspend or terminate for material breach of these terms, with notice where practicable.

9. Disclaimers and liability

The service is provided "as is" during early access. To the maximum extent permitted by law, we disclaim implied warranties, and our aggregate liability is limited to the amounts you paid us in the twelve months before the claim. Nothing here limits liability that cannot lawfully be limited.

10. Changes

We may update these terms; material changes are announced in the product or by email at least 14 days before they take effect. Continued use after the effective date is acceptance.
